1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and 48HoursBanners.com ("Company," "we," "us," or "our") governing your use of our website and custom banner printing services.
By placing an order, accessing our website, or utilizing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
2. Services Description
48HoursBanners.com provides custom banner printing services, including but not limited to vinyl banners, mesh banners, fabric banners, and related signage products. Our services include:
- Custom banner design and printing
- Digital proof creation and approval process
- Production and manufacturing of ordered products
- Shipping and delivery services
3. Order Process and Acceptance
3.1 Order Placement
Orders may be placed through our website, Etsy marketplace, or other authorized sales channels. By submitting an order, you are making an offer to purchase our products subject to these Terms.
3.2 Order Confirmation
We reserve the right to accept or decline any order at our sole discretion. An order is not considered accepted until we send an order confirmation and begin the production process. We may refuse orders that contain inappropriate content, infringe upon intellectual property rights, or violate applicable laws.
3.3 Pricing and Payment
All prices are displayed in United States Dollars (USD) and are subject to change without notice. Payment must be received in full before production begins. We accept major credit cards and other payment methods as indicated on our website. All transactions are processed securely through our authorized payment processors.
4. Proof Approval Process
4.1 Digital Proofs
For custom orders, we will provide a digital proof for your review and approval before production. The proof represents a visual approximation of the final product and may vary slightly in color due to monitor calibration differences.
4.2 Customer Responsibility
It is your sole responsibility to carefully review all aspects of the proof, including but not limited to:
- Spelling, grammar, and punctuation
- Names, dates, and numerical information
- Design layout and positioning
- Image quality and resolution
- Color accuracy (to the extent visible on your display)
4.3 Approval Authorization
By approving a proof, you authorize us to proceed with production exactly as shown. Once approved, we are not responsible for any errors that were present in the approved proof. No refunds, reprints, or credits will be issued for errors that existed in an approved proof.
4.4 Revision Requests
If you require changes to your proof, you may request revisions through our customer portal. We will provide a reasonable number of revisions at no additional charge. Excessive revision requests or significant design changes may incur additional fees.
5. Production and Delivery
5.1 Production Timeline
Our standard production time is 48 hours from proof approval, excluding weekends and holidays. Production timelines are estimates and may vary based on order volume, complexity, and unforeseen circumstances.
5.2 Shipping
Shipping times vary based on destination and selected shipping method. We are not responsible for delays caused by shipping carriers, weather conditions, customs processing, or other circumstances beyond our control.
5.3 Risk of Loss
Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not liable for lost, stolen, or damaged packages once transferred to the carrier. For shipping-related issues, we will assist in filing claims with the carrier.
6. Intellectual Property
6.1 Customer Content
You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use any content (including images, logos, text, and designs) that you submit for printing. You agree to indemnify and hold us harmless from any claims arising from your submitted content.
6.2 Prohibited Content
We reserve the right to refuse orders containing:
- Content that infringes on copyrights, trademarks, or other intellectual property rights
- Obscene, defamatory, or offensive material
- Content that promotes illegal activities
- Counterfeit or unauthorized branded merchandise
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 48HoursBanners.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
Our total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific order giving rise to the claim.
8. Warranties and Disclaimers
We warrant that our products will be free from material defects in workmanship for a period of 30 days from delivery. This warranty does not cover damage resulting from misuse, improper installation, normal wear and tear, or exposure to extreme conditions.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
9. Indemnification
You agree to indemnify, defend, and hold harmless 48HoursBanners.com, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your breach of these Terms; (c) your violation of any third-party rights; or (d) any content you submit for printing.
10. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class action lawsuits or class-wide arbitration.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes. We encourage you to review these Terms periodically.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
